Conditions of Sale

We sell three kinds of things: professional services quoted and delivered by our team (SAP calculations, assessments, testing and consultancy), instant reports purchased online through our free calculator tools, and the Monkey Pro subscription. Part A below applies to quoted professional services; Part B applies to one-off online tool purchases; Part C applies to Monkey Pro subscriptions. Nothing in these conditions affects your statutory rights.

Part A — Professional services (quoted work)

PRICES — All prices quoted are NETT and exclude VAT or local taxes and duties if applicable. The quoted price allows for and includes any agreed discounts.

VALIDITY — The prices are fixed and remain firm providing your acceptance is received within the validity period shown on the quotation and that delivery is taken within the period specified. If unspecified, validity is 30 days from quotation date.

TERMS OF PAYMENT — Payment is to be made within 7 days of the date of the invoice for credit approved customers unless payment terms are agreed otherwise. Payment terms for non credit approved customers is cash in advance. If credit is agreed the terms will be specified but we reserve the right to vary the conditions of the trading dependent upon previous credit experience. Where credit is agreed we retain legal title to any goods or services supplied until all monies due have been paid. In the event of delayed payment of account we reserve the right to charge interest on any overdue account at the rate of a minimum of 1% per month above the Bank of England base rate from the date on which the payments become due and should the account fall into three months arrears, we reserve the right to reclaim any supplied goods and charge late payment & debt recovery fees (including County Court fees).

LIMIT OF LIABILITY — Any advice supplied is strictly on the following conditions: It is intended solely for use by the addressee and may not be disclosed, copied or distributed without the written permission of the Company. When addressed to our clients any opinions or advice or information contained therein shall not constitute a binding obligation unless expressly indicated. The Company or its employees or servants shall not be liable for any damages or costs, whether direct or consequential, however so arising from any advice or information given or supplied in the course of its operations.

Part B — Online tools and instant reports

This part applies when you buy a PDF report through one of our online calculator tools (currently ΨMonkey, WaterMonkey, SoakMonkey, NutrientMonkey and U-Monkey). Using the calculators themselves is free and creates no contract; these conditions apply from the point you pay for a report.

WHAT YOU ARE BUYING — An automatically generated PDF report of the calculation you have built in the tool, produced from the inputs you entered, using the published methodology stated in the tool and on the report. It is digital content, supplied by download. You are responsible for the accuracy and completeness of the inputs: the report faithfully calculates from what you enter, and cannot detect errors in what you tell it. Each report states its methodology, its inputs and any assumptions on its face, and carries a unique report ID.

PRICES AND PAYMENT — Prices for online reports are stated at the point of purchase excluding VAT; VAT at the prevailing UK rate (currently 20%) is added at checkout and the VAT-inclusive total is shown before you pay. Payment is taken in full at the time of purchase by card via Stripe; we never see or store your card details. Your Stripe receipt is your proof of purchase.

DELIVERY — The report is generated and downloaded in your browser immediately after successful payment. If payment succeeds but the report cannot be delivered — for whatever reason — and you do not retrieve it using the retry option, the payment is refunded automatically in full, normally within the hour, with no action needed from you.

CANCELLATION — Because the report is digital content generated and supplied immediately at your request, by completing the purchase you expressly agree to immediate supply and acknowledge that you lose the statutory 14-day right to cancel once the report has been delivered. In plain English: once you have your report, the purchase is complete. This does not affect your remedies if the content is faulty (see below), and our refund practice is deliberately generous: undelivered reports refund automatically, and minor corrections can be re-exported free for 24 hours after purchase. Substantial changes to the calculation inputs count as a new calculation and a new report.

IF SOMETHING IS WRONG — Under the Consumer Rights Act 2015, digital content must be as described, fit for purpose and of satisfactory quality. If a report you have paid for is defective — it does not reflect the inputs you entered, or misapplies the stated methodology — contact us at mail@energycount.co.uk with your report ID and we will repair, replace or refund it.

INTENDED USE AND RELIANCE — Reports are prepared using published UK methodologies for submission in support of Building Regulations or planning applications, as stated in each tool. Where a tool describes an output as a screening assessment (for example the ISO 13788 condensation-risk screening), the report says so and it should not be treated as a substitute for a site-specific professional assessment. Acceptance of any submission rests with the relevant authority. The report is licensed for use on the project for which it was produced; it may be shared with your project team, designers and the relevant authority for that purpose.

LIMIT OF LIABILITY (ONLINE REPORTS) — Online reports are automated calculations from your inputs, priced accordingly. Our total liability arising from any online report is limited to the price you paid for it, except that nothing limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. We are not liable for losses arising from inaccurate or incomplete inputs, or for use of a report outside its stated purpose. If you need advice, checked inputs and professional responsibility for the result, that is exactly what our quoted professional services are for — we would genuinely rather you bought the right thing.

THE FREE TOOLS — The calculators are provided free of charge in the hope they are useful, without warranty of any kind. On-screen results are for information; only a purchased (or, where offered, free) PDF report is intended to be relied on as a record of a calculation.

Part C — Monkey Pro subscriptions

This part applies when you take out a Monkey Pro or Monkey Pro Unlimited subscription through your account page. It is a separate contract from any one-off report you buy under Part B, and the cancellation terms in Part B do not apply to it. The calculators themselves remain free to use with or without a subscription.

WHAT YOU ARE BUYING — A subscription to the Monkey Pro features across every Energycount online tool on your account, for one named user. Monkey Pro puts your practice on the reports you produce (your logo, practice name, address and contact lead the report header, our wordmark drops to a credit line, our closing page is removed, and each report can carry your project name, number, client and revision reference), and gives you the member rate on one-off reports — currently £15 +VAT for a thermal bridge (ΨMonkey) report instead of £35, and £10 +VAT for a condensation risk (ISO 13788) report instead of £25. Monkey Pro Unlimited includes everything in Monkey Pro and, in place of the member rate, includes thermal bridge and condensation risk reports at no further charge, subject to the fair-use terms below. Reports from the other tools (Part G water efficiency, soakaway/SuDS and nutrient neutrality) are bought one-off under Part B at the published price on either tier. A subscription does not change how any calculation is performed, and does not include quoted professional services under Part A.

PRICES, VAT AND AUTOMATIC RENEWAL — Prices are stated excluding VAT; UK VAT at the prevailing rate (currently 20%) is added at checkout and the VAT-inclusive total is shown before you pay. The current prices are Monkey Pro £19 +VAT a month or £190 +VAT a year, and Monkey Pro Unlimited £49 +VAT a month or £490 +VAT a year. This is a recurring subscription: it renews automatically at the end of each billing period — monthly or annual, as you chose at checkout — at the same price, and the card you registered is charged again each time, until you cancel. Payment is taken by card through Stripe; we never see or store your card details, and your Stripe invoice for each period is your proof of purchase. If we change the price of your plan we will tell you by email at least 30 days before the change takes effect, so you can cancel first if you would rather not continue; your existing period is never re-priced.

HOW TO CANCEL — Cancel whenever you like, online, without contacting us: sign in, go to your account page and use Manage subscription, which opens the Stripe billing portal. The same portal is where you update your card and download your invoices. Cancellation takes effect at the end of the period you have already paid for — you keep the Monkey Pro features until then and there is no pro-rata refund of the current period, because the period has been supplied to you in full. Nothing is charged after that. This is separate from, and additional to, the 14-day right below.

CHANGING TIER — Moving between Monkey Pro and Monkey Pro Unlimited is not yet a self-serve button. Email info@energycount.co.uk and we will move you across and settle the difference fairly for the period concerned. We have deliberately blocked the self-serve route rather than let anyone end up paying for two subscriptions at once.

YOUR 14-DAY RIGHT TO CANCEL (CONSUMERS) — If you are a consumer (you are not buying for the purposes of your trade, business, craft or profession), you have a statutory right to cancel this subscription within 14 days of taking it out, without giving a reason. Tell us at info@energycount.co.uk within that period — a clear statement is enough. Because the subscription starts immediately at your request, we may charge for what you have actually used, so we will refund what you paid for the current period less a proportionate amount for the days you had access, and less the ordinary one-off price of any reports you exported under the subscription during those days — never more, in total, than you paid us. This right applies to the subscription itself and is not affected by the immediate-supply acknowledgement in Part B, which applies only to individual downloaded reports. Reports you exported during the 14 days remain yours to use; that is why they are accounted for in the refund. Most of our subscribers are practices buying in the course of business, and the 14-day right does not apply to them — but our cancel-any-time terms above do, for everyone.

FAIR USE (UNLIMITED) — Monkey Pro Unlimited is sold for the work of one named user: it means as many thermal bridge and condensation risk reports as your own projects genuinely need. It is not a shared login for a team or an office, and it may not be used to produce reports as a bureau service resold to others; each person needs their own subscription. So that we can apply this fairly, we count the number of reports issued under an Unlimited entitlement, per account, per calendar month, and keep that count for a short period. There is no hard cap and we do not intend to introduce one; if a pattern of use looks inconsistent with a single user we will contact you first and give you a reasonable opportunity to explain or to add the subscriptions you need, and only after that may we suspend or terminate the subscription, refunding any unused whole period. We will not use this clause to penalise a genuinely busy single user.

WHEN THE SUBSCRIPTION ENDS — At the end of your paid period the Pro features stop: new reports come out in the standard Energycount form, and one-off reports are charged at the list price rather than the member rate. Everything you produced while subscribed stays yours — reports already exported keep your branding, remain licensed for the project they were produced for, and their report IDs stay verifiable at energycount.co.uk/verify indefinitely. Your practice details and logo stay on your account unless you delete them, so re-subscribing later picks up where you left off. If we ever have to withdraw a tool or the subscription itself, we will give you reasonable notice and refund any period you have paid for but not received.

ACCOUNT AND ACCESS — Your account is accessed by a one-time email sign-in link rather than a password; keep access to that mailbox secure, and treat the sign-in link as personal to you. Tell us promptly if you think someone else has gained access to your account. We may suspend an account where we reasonably believe it is being used fraudulently, or in a way that breaches these conditions.

LIMIT OF LIABILITY (SUBSCRIPTIONS) — Our total liability arising from the subscription is limited to the subscription fees you paid for the period in which the matter arose, and the limits and exclusions in Part B apply to the individual reports you produce under it. Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If a paid feature is unavailable for a material part of a period, tell us and we will extend or refund that period.

General

ABOUT US — Energycount Limited, England. Contract language is English and these conditions are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that if you are a consumer you retain any protections and forum rights the law gives you where you live.
